Welcome to Harmony Control. These Terms of Use ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use Harmony Control. The Service is intended only for adults engaging in consensual relationships. You represent that you meet these requirements and that all activity on your account reflects informed, voluntary consent between adults.
2. Nature of the Service
Harmony Control provides software tools for relationship structure, communication, tracking, and gamification—including features related to consensual power-exchange dynamics. The Service is not medical, psychological, legal, or therapeutic advice. We do not supervise your relationships, verify identities beyond basic account registration, or guarantee the conduct of any user.
You are solely responsible for:
- Negotiating boundaries, limits, safewords, and consent with your partner(s) outside the app;
- Ensuring all real-world activity is safe, sane, consensual, and lawful;
- Deciding whether content, tasks, contracts, or rules created in the app are appropriate for your situation.
3. Account registration
You agree to provide accurate registration information, keep your credentials secure, and notify us promptly of unauthorized access. You may not share your account, impersonate others, or register on behalf of another person without authority.
By registering, you confirm that you have read and agree to these Terms and the Privacy Policy at the version in effect at the time of signup.
4. Acceptable use
You may not use the Service to:
- Harass, threaten, exploit, or coerce any person;
- Engage in or promote non-consensual activity, illegal conduct, or harm to minors;
- Upload malware, scrape the Service, or attempt unauthorized access;
- Violate applicable laws or third-party rights;
- Misrepresent your identity, age, or consent status.
We may suspend or terminate accounts that violate these rules or pose risk to users or the platform.
5. User content and relationships
You retain ownership of content you submit (journals, contracts, rules, Harmony Hub entries, messages, etc.). You grant Harmony Control a limited license to host, store, display, and process that content solely to operate the Service for you and your connected partner(s).
Content you share within a relationship is visible to participants in that relationship according to app permissions. You are responsible for what you record and share.
6. Subscriptions and payments
Some features may require paid subscriptions or store purchases. Prices, billing cycles, and refund policies will be shown at checkout. Failure to pay may limit access to paid features. Free-tier access remains subject to these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Harmony Control AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR RELATIONSHIP OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).
9. Indemnification
You agree to indemnify and hold harmless Harmony Control from claims arising out of your use of the Service, your content, your relationships, or your violation of these Terms or applicable law.
10. Changes
We may update these Terms from time to time. We will post the revised version with a new effective date. Material changes may require you to accept the updated Terms before continued use. Your continued use after notice constitutes acceptance where permitted by law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, legal requirements, or operational reasons. Provisions that by nature should survive (disclaimers, liability limits, indemnity) survive termination.
12. Governing law
These Terms are governed by the laws applicable to the operator of Harmony Control, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory consumer protection law in your country.
